2024 Virtual Regulatory Summit Recap https://dentaltradealliance.org/news/667926/ https://dentaltradealliance.org/news/667926/ The DTA and Regulatory Affairs Committee Chairman Grant Ramaley recently hosted the DTA's 2024 Regulatory Affairs and Compliance Virtual Summit. This virtual event included a wide range of presenters from the FDA’s Center for Devices and Radiological Health, DTA Regulatory Attorney Rick Van Arnam, E.U. Regulatory Experts Advena, to Reed Tech and medical industry consultants – DQS. Check out a few of the highlights from the two-day program below.

Day 1 Recap - U.S. Medical Devices

On day one, the focus was on U.S. medical devices with the executive team and the reviewers from the FDA’s Center for Devices and Radiological Health covering a myriad of topical issues including:

  • the DICE Program to assist manufacturers
  • updates on current 510(k) submissions
  • 3–D Printing discussions around custom made 3–D printed medical devices
  • the e–Star program to accelerate 510(k) submission approvals
  • software issues and when is a medical device software – a stand alone device that needs 510(k) approval and other functions of medical device software
  • cybersecurity updates with new FDA links to assist manufacturers so they can avoid any malicious cyber attacks.

Day 2 Recap - International Activities

Day two focused on international activities, specifically the ever changing, ever challenging European Union Medical Device Regulations. Industry consultant Advena provided a step-by-step overview of what is involved for U.S. manufacturers looking to get their dental devices approved to sell in the European Union under the new E.U. MDR rules. Based on the many questions surrounding these new regulations, there seems to be an appetite for some additional stand-alone educational programs on E.U. MDR implementation. Reed Tech also did a deep dive into changes and challenges for Unique Device Identification under the new E.U. MDR system.]]>

New Test for Determining Whether One is an Employee or an Independent Contractor https://dentaltradealliance.org/news/663203/ https://dentaltradealliance.org/news/663203/ On January 9, 2024, the U.S. Department of Labor released a final rulemaking that changed its test for determining whether a worker is an employee or an independent contractor under the Fair Labor Standards Act (FLSA). This final rule rescinds the existing 2021 independent contractor rule and replaces it with a multifactor economic reality test. This new test goes into effect on March 11, 2024.

The new test adopts a totality of the circumstances approach, and looks to several economic factors to determine if, as a matter of economic reality, an individual is an employee or an independent contractor under the FLSA. No one factor is considered more important than the others; however, situational circumstances could result in one or more factors having differing importance. In determining whether a worker is an employee under the FLSA, the following factors will be considered:

  1. The worker’s opportunity for profit or loss depending on their managerial skills – This criterion looks at a worker’s independence in making and exercising managerial decisions. For example, does the worker negotiate what they charge or what they are paid? Can the worker decide which jobs to perform or how to grow their business? Does the worker make hiring or other managerial decisions? “Yes” responses to these and similar questions weigh in favor of finding an independent contractor.
  2. Investments made by the worker – this criterion analyzes whether any investments made by the worker are capital or entrepreneurial in nature. Investments of new capital or actions that are entrepreneurial in nature typically serve a business-like function by increasing a worker’s ability to do more or different work, or to do it more cost effectively. These types of investments are indicative of an independent contractor. They should not, however, be confused with work-related expenses imposed by an employer on a worker required to perform a specific job, such as the cost of tools and equipment necessary for performance.
  3. Degree of permanence of the work relationship – Where the work relationship is indefinite in duration or continuation, or is exclusive of work for other employees, then this factor would weigh in favor of the worker being an employee.
  4. The nature and degree of control – This factor looks at who can control the work and economic aspects of the workplace. For example, does the worker have control over factors such their work schedules or who supervises them? Is the worker free to work for others? Also important to this factor are things like who controls the economic aspects of the working relationship, such as who sets prices or rates for services, or markets the services or products of the worker. An employee relationship is supported where the worker does not control these and similar factors.
  5. The extent to which the work performed is an integral part of the potential employer’s business – Is the function being performed by the worker an integral part of the business? If so, then the work being performed, being critical, necessary, or central to the potential employer’s business, weighs in favor of the worker being an employee.
  6. Skill and initiative required for job – Whether the worker uses specialized skills to perform the work required of the position is considered under this factor. If the work is not specialized, or the employer must train the worker to perform the work, then this factor weighs in favor of finding that the worker is an employee. While both employees and independent contractors can bring specialized skills to a workplace, an independent contractor status arises where the use of those skills supports the worker’s, rather than the employer’s, business initiatives.
  7. Additional factors – Factors in addition to the ones highlighted above may also be considered if those factors shed light on whether the worker is in business for themself, or economically dependent on someone else.

No single factor determines whether a worker is an employee or an independent contractor. Instead, these economic reality factors are assessed and weighted to answer the question. Also, a worker cannot voluntarily choose to be considered an independent contractor. If an employee is an employee under the economic reality factors, then the worker is an employee for purposes of the FLSA.

One last point. The economic reality factors are to be used for determining worker classification under the FLSA. Similar determinations under other laws, such as the Internal Revenue Code or various state laws, are controlled by definitions germane to those laws.

An Open Letter from Ted Kehagias, New Chair, DTA Board of Directors

It is my privilege to have been elected the 2023-24 Chair of the Dental Trade Alliance (DTA) Board of Directors. I look forward to a productive year representing the needs of our diverse membership.

I would first like to thank Tim Rogan for an incredible term as Chair of the DTA Board of Directors. The 2023 DTA Annual Report does a great job of capturing the many organizational successes that occurred during Tim’s Chairmanship. As I shared during the recent DTA Annual Meeting, Tim and I started in the dental industry at the same time, and I’m honored to be following him as Chair of the DTA Board of Directors.

In my expanded DTA role, I will continue to champion Tim’s important work including the continued expansion of the DTA Washington Policy Summit (formerly the Washington Conference) as well as the strong support of the Dental Trade Alliance Foundation Robert Tanner Freeman UNCF Dental School Scholarship initiative.

The dental industry is potentially on the verge of a transformational shift to the dental care delivery system. Based on healthcare delivery efficiencies, commercial dynamics and government policy, we are witnessing an alignment of the Medical and Dental Healthcare sectors.

In just the last two years we’ve seen these tangible examples of the integration actively occurring within the Centers for Medicare and Medicaid (CMS):

  • Natalia Chalmers, DDS, MHSc, PhD named as the first ever CMS Chief Dental Officer;
  • CMS expanded Medicare to cover Dental procedures when deemed medically necessary;
  • In the last month CMS released the 2024 Physician Fee Schedule which, for the first time, included dental reimbursement details for select medical procedures.

To help prepare our member companies for the potential changes caused by this business evolution, DTA is partnering with CHARM Economics, a healthcare think-tank. I’m pleased to share that as a free benefit of DTA membership, over the course of the next year, CHARM Economics will be providing our members with a series of business-related insights on how Medical Dental Integration (MDI) could impact the supply side of the dental industry.

It is my hope that this strategic initiative will bring forth information and insights that will allow members to take advantage of the growth opportunities and perhaps prepare for the economic pressures the MDI model will create. Please watch for more details on this important strategic business initiative.

Finally, DTA is your trade organization. From business connections to regulatory and policy insights and dental market intelligence please let us know how DTA can best support your organization.

In Memoriam–Rebecca Binder of the Benco Family Foundation https://dentaltradealliance.org/news/647188/ https://dentaltradealliance.org/news/647188/ DTA extends its condolences to the Cohen and Benco Families for the loss of Rebecca Binder.

The dental industry recently lost a great leader in the community. Rebecca Binder, Executive Director of the Benco Family Foundation, passed away last week at the too-young age of 57, following a valiant battle with breast cancer.

Rebecca was a friend and colleague to the DTA & the DTA Foundation. It was a privilege to work with her on the Dr. Robert Tanner Freeman Scholarship and the new Larry & Sally Cohen Endowed Scholarship Fund for Dental Hygiene. She worked hard and thoughtfully to address access to care and education for those who were often overlooked or left behind.

As Executive Director of the Benco Family Foundation, Rebecca spearheaded projects that improved access to dental care around the world (Global Smiles Foundation), educated children in poor communities on dental health (Lessons in a Lunchbox), and provided tuition for dental students of color (the Robert Tanner Freeman Scholarship).

If you would like to make a donation in Rebecca's memory, the family has established the Rebecca Binder Memorial Scholarship Fund at Moravian Academy (7 East Market Street, Bethlehem, PA 18018) to provide scholarships for disadvantaged children in the Lehigh Valley and a fund-raiser at Memorial Sloan Kettering to fight rare forms of breast cancer at http://mskcc.convio.net/goto/RebeccaBinder

Rebecca's life will be celebrated with a Memorial Service on Monday, July 31st at 11AM at Temple Keneseth Israel, 2227 Chew Street, Allentown PA. The family will receive visitors at their home on Monday, July 31st from 6-9PM, and on Tuesday, Wednesday, and Thursday from 2-4PM and 6-9PM.

In Memoriam–Michael Paul Beaudoin of Kerr/Envista https://dentaltradealliance.org/news/645237/ https://dentaltradealliance.org/news/645237/ DTA extends its condolences to the Kerr/Envista families for the loss of Michael Paul Beaudoin.

The dental industry community recently lost a great colleague, partner, ambassador, and friend. After a prolonged battle with cancer, Michael Paul Beaudoin passed away peacefully on May 30, 2023. Mike leaves behind his wife Laura of 37 years, two beautiful children and a granddaughter, who was an especially bright light in his life.

Mike began his dental career over 30 years ago in 1990, as a field sales person in Colorado, with Ormco orthodontics, part of the former Sybron Dental group. Immediately successful, he earned top Sales Person of the Year honors twice in his first three years, prior to being promoted to the Sales Operations Manager at Kerr in 1993. Over the next 20 years, Mike saw numerous roles of increasing responsibility rising to the position of VP of Corporate Accounts in North America. Over the span of his career, Mike’s unforgettable smile, contagious positive energy and commitment to serving his customers won him friends and fans across the industry among his dealer customers, industry peers and within Kerr/Envista.

“Yes, we were all devastated by the news. Mike called on NDC for years and always had respect and consideration for the independent distributors. As stated in his obituary, his smile was contagious! He often came to see us in Nashville with his boots and cowboy hat!” –Lori Paulson, NDC.

“Mike was one of the first people I met when I started working at Kerr 29 years ago. Mike was one of the people I interviewed with–we ended up playing Nerf basketball in his office as he interviewed me with great questions to see if I would be a good fit for the Kerr culture. This typified what Mike was all about; a keen awareness for business while also being light-hearted, quick to praise, slow to anger and always with a smile. Mike was a gentleman’s gentleman – extremely respectful of others at all times and a kind man while also being strong. He will be missed.” –Ed Shellard, United Concordia.

“Mike was a good friend. I was introduced to him upon joining Danaher’s dental platform in 2015 and was taken by how committed, insightful, collaborative, and genuine he was. Everyone liked him. I remember the day he handed in his resignation, convinced that he would be a burden to the organization if he was unable to balance his work and health. I encouraged him to stay–he was a valuable member of our team and I wanted to make sure he knew we would be here for him. He stayed for 4 more years. Even after he retired, he never stopped caring about us and this industry. Mike had a heart of gold and we will miss him.” –Amir Aghdaei, Envista Dental.

For those wishing to make a gift in Mike’s honor, the Beaudoin family would welcome your support by either contributing to the American Cancer Society, or The Leonard Cancer Institute at Mission Hospital.

Envista Smile Project Donates $50,000 to Dr. Robert Tanner Freeman Scholarship

Washington, DC / April 5, 2023 - The DTA Foundation is excited to announce that Envista Smile Project has donated $50,000 to the Dr. Robert Tanner Freeman Scholarship, which aims to increase diversity in the dental field. Envista’s contribution to this scholarship aligns with its philanthropic mission–to improve the smiles and oral health of disadvantaged communities by supporting increased access to oral care and oral health education.

People of color are greatly underrepresented among the dentist and hygienist workforces. According to a Journal of American Dental Association study, Elevating dentistry through diversity, “Today, dental schools have student populations that are more diverse but still do not reflect the current U.S. population. And it does not seem to be moving in that direction.”

The Dr. Robert Tanner Freeman Scholarship aims to change that by providing scholarships to underrepresented minorities looking to start their dental education. The initiative was established by the DTA Foundation in June 2021, in partnership with the UNCF (United Negro College Fund) to increase diversity and improve access to the oral healthcare profession.

“Black dentists are significantly underrepresented in the United States,” said Sarah Miller, Executive Director, DTA Foundation. “That is why the support of this scholarship is crucial for diversifying the dental field. We are grateful for this the gift from Envista Smile Project and look forward to expanding this partnership in the future.”

Launched in July 2021, Envista Smile Project is a philanthropic foundation dedicated to providing oral health education to underserved communities around the world. In 2022, the non-profit organization donated more than $650,000 in charitable giving. In 2022 the Smile project also:

  • Provided free dental care to more than 600 patients in need in the Dominican Republic.
  • Donated goods for cleaning, cavity prevention and treatment, and consumables to Heartland Dental supporting their "Free Dentistry Day".
  • Partnered with the Special Olympics, New Jersey providing access to a Nomad portable x-ray.

"We are proud to support the Dr. Robert Tanner Freeman Scholarship and to empower the future generation of students pursuing a career in dentistry," said Amir Aghdaei, Envista CEO and Envista Smile Project Chairman. "We look forward to seeing how these students will make a positive difference in dentistry for years to come."

If you are interested in supporting this scholarship, contact Sarah Miller, Executive Director, at sarahmiller@dentaltradealliance.org or (703) 379-7755.

Updated Study Finds Healthcare Cost Savings Could
Top $22 Billion Annually with Better Access to and
Adoption of Oral Healthcare

Dental Trade Alliance releases latest Oral Healthcare Can’t Wait® study that highlights major potential for US healthcare savings

Arlington, VA / March 7, 2023 - The Dental Trade Alliance (DTA) has officially released its 2022 Oral Healthcare Can’t Wait® study highlighting the significant connection between oral healthcare and the overall health of Americans. The new study is a refreshed look at an earlier study commissioned by the DTA and focuses specifically on populations of the country that are under-insured or completely without dental insurance.

Key findings of the study, performed by Dr. Uma Kelekar, Assistant Professor of Health Care Management and Legal Studies at the Marymount University School of Business Administration, include:

    • $7.4 billion in diabetes-related healthcare costs could be subverted by improved and regular periodontal care.
    • 126 million hours of work and school absence in the country annually can be attributed to unplanned or emergency dental care.
    • $22.8 billion in US healthcare costs could be saved annually with increased access to care and awareness of the importance of oral health.

“This study is an important one for the oral healthcare community, but also for the healthcare community at large,” says Greg Chavez, CEO of the Dental Trade Alliance. “Research increasingly shows the connection between oral health and overall health, and these numbers illustrate that we can both save lives and save money as a country by committing to oral health advocacy.”

Detailed information about the study and downloadable fact sheets for patients, business owners, and government officials can all be downloaded at oralhealthcarecantwait.com. These materials have been created in response to the findings of the study are being used to help bring awareness to various audiences throughout the United States. For more information about the study, please contact Amy Moorman, Vice President of Operations of the DTA, at amymoorman@dentaltradealliance.org

Updates from the ISO TC 106 Meetings in Berlin https://dentaltradealliance.org/news/618187/ https://dentaltradealliance.org/news/618187/ More than 140 volunteers from ISO TC 106 attended a week of meetings in Berlin including staff from FDA’s Devices for Devices and Radiography. More than 100 working groups met face to face and virtually over a two week period. Topics covered included dental hand instruments, dental equipment, implants, dental terminology, dental handpieces, oral rinses, manual toothbrushes, electrical dental devices and many more. Many of the TC 106 Working Groups will continue their projects on-line in the coming months and culminating with the next ISO TC 106 Meeting in September 2023 in Sydney, Australia.

DTA is seeking more industry representative to participate in the ANSI and international ISO standards. For more information for participating in Dental Standards, please contact Fred Freedman fredfeedman@dentaltradealliance.org at DTA.

More than 40 U.S. volunteers, industry representatives along with FDA and ADA staff participated in ISO TC 106 Meetings over six days in Berlin, Germany. U.S. industry participation allows U.S. companies to shape and write the standards for all dental devices, equipment and ancillary products in the dental space. Without U.S. participation, other international manufacturers have an opportunity to write standards that in some cases supports their device specifications but may be at odds with U.S. manufacturing.

FDA issues final guidance of Class I medical devices and need to report UDI data https://dentaltradealliance.org/news/612227/ https://dentaltradealliance.org/news/612227/ On July 22, 2022, the U.S. Food and Drug Administration published in final form its guidance document on Global Unique Device Identification Database (“GUDID”) reporting requirements for Class I medical devices. The draft guidance document had been published on October 14, 2021, and the new, final document reflects some changes brought forth by commentators. The highlights of the final document are as follows:

1. The upcoming September 24, 2022, compliance deadline for all Class I GUDID reporting has been pushed back to December 8, 2022. However, September 24, 2022, remains the deadline for meeting the UDI labeling requirements.

2. The guidance document exempts from GUDID reporting Class I medical devices that meet the definition of “consumer health products.” This term is defined as:
  a. A 510(k) exempt Class I medical device;
  b. Sold directly to consumers over-the-counter via brick-and-mortar or online stores; and,
  c. Do not fall into one of five categories of devices that the FDA deems of greater risk to the public health. These categories are:
    i. Class I Reserved Devices
    ii. Restricted Devices
    iii. Implantable Devices
iv. Life-Supporting or Life Sustaining Devices
    v. Certain Devices Distributed by Professional Healthcare Facilities and Intended for Use by Healthcare Professionals Only.

3. All other Class I medical devices that do not meet the definition of “consumer health products” are subject to UDI labeling and GUDID reporting.

4. The FDA has created a hotline for those who have questions whether their devices are considered “consumer health products” at GUDIDSupport@fda.hds.gov.

California Law Imposing Label Requirements for Pre-moistened Non-woven Disposable Wipes In Effect https://dentaltradealliance.org/news/611612/ https://dentaltradealliance.org/news/611612/
In October 2021, California amended its Integrated Waste Management Act of 1989 to require certain pre-moistened non-woven disposable wipes manufactured on or after July 1, 2022 be labeled clearly and conspicuously with the phrase “Do Not Flush” and with the “Do Not Flush” symbol. DTA members who manufacture such wipes, or who are wholesalers, suppliers, or retailers responsible for labeling or packaging such wipes, are subject to this requirement.

Not all wipes are impacted by the July 2022 deadline. To fall within the scope of the law, the wipes must be either: 1) marketed as a baby wipe or a diapering wipe, or 2) are composed entirely or in part of petrochemical-derived fibers and are likely to be used in the bathroom and have a significant potential to be flushed

The change in law establishes enforcement provisions too. Civil penalties ranging from $2,500 to $100,000 per violation can be imposed on those companies covered by the law but who violate its provisions. Private Right of Action related enforcement is not in place with this California regulation.

The law creates additional educational outreach and other reporting requirements. As an example, the bill creates the California Consumer Education and Outreach Program, under which companies covered by the law are required to participate in a collection study conducted with California wastewater agencies to learn about consumer behavior regarding flushing pre-moistened non-woven wipes. Companies need to report annually to certain state legislative committees and administrative agencies. These requirements and the outreach program are scheduled to sunset on January 1, 2027.

Like most labeling laws, this law sets out specific requirements for how the label is to look. Therefore, companies impacted by this law need to review it to ensure that its labels are legally sufficient. Also, this California state law does not supersede any other federal or state laws that already regulate these items. Questions about this issue can be directed to Rick Van Arnam, the Dental Trade Alliance’s regulatory affairs counsel, at rvanarnam@barnesrichardson.com.]]>
